Deputy Director of Procurement - Diversity, Design, and Construction POSITION DETAILS The Capital Procurement Services unit of CUNY's Office of Facilities Planning, Construction and Management (FPCM) procures contracts and task orders with consultants and contractors for multiple projects in: design, construction, real estate planning, architectural design, engineering design, master planning, construction, construction management/build services, general contracting, trades contracting, and property development, including public private partnerships. The Deputy Director is responsible for ensuring that the agency's procurements and resultant contracts, from inception through completion, comply with requirements for certified Minority and Women owned Business Enterprises (MWBEs) and Service Disabled Veteran Owned Businesses (SDVOB) programs. The Deputy Director also has oversight of: (1) registering New York City capital funds and (2) overseeing and managing the full range of activities necessary to develop, solicit, negotiate, award, and register design, construction, and construction-related services contracts. Additional responsibilities include ensuring compliance with the City University Construction Fund (CUCF) Procurement Guidelines and all applicable local, state, and federal laws and regulations. Reporting to the Director of Capital Procurement Services at CUNY's Office of Facilities Planning, Construction and Management, the Deputy Director of Procurement Diversity & Design and Construction Contracts supervises procurement staff and has overall responsibility for the following: - Manage the full range of compliance activities necessary for meeting goals and report to New York State ESD and NYS OGS, including, but limited to administer and send waiver requests when MWBE or SDVOB goals are not feasible; ensure MWBE goals and contractor responses are accurate and meet the necessary requirements; manage and approve the MWBE portion of contract preparation for submission to oversight agencies such as EDS, OGS, OSC and City Comptroller when applicable.
- Liaise proactively on MWBE and SDVOB matters with NYS Empire State Development (ESD), NYS Office of General Services (OGS)-SDVOB, agency design and construction staff,procurement, legal and financial staff, contractors and other external oversight agencies.
- Produce annual scheduled goal plans, compliance and management reports, and maintain a database on agency MWBE and SDVOB utilization and milestones, prepare expenditure/utilization spreadsheet for quarterly reporting, respond to ESD and NYS-OGS requests for periodic information and prepare data and information for presentation to CUCF and CUNY Boards of Trustees and other stakeholders.
- Oversee and assist the Director and staff with review of procurement contracts and change orders to ensure compliance with state and local regulations when necessary.
- Plan and represent the agency at MWBE and SDVOB local and out-of-town outreach events and conferences and participate on The Competitive Edge Conference committee to planevents for the SDVOB and MWBE annual conference; participate in panels at partner agencies, professional organizations, and other events.
- Assess and select the appropriate method of procurement and establish procurement plans and schedules in accordance with best procurement practices, CUCF procurement guidelines and applicable laws and regulations.
- Collaborate and coordinate with internal and external stakeholders at various organizational levels including program, legal, finance/budget, vendor integrity, colleges, oversight agencies, and vendors, to achieve a superior, seamless support service function that results in timely and effective awards to responsive and responsible vendors.
- Coordinate the planning and implementation of the City University of New York (CUNY) annual procurement opportunity conference.
- Recommend opportunities to improve service and procurement functions to Executive Staff; oversee the implementation and rollout of such improvements.
- Assist colleges with NYC (Capital Fund) registration issues.
- Obtain Certificates to Proceed (CPs) for DASNY transfer and submit documentation for registration by the NYC Comptroller.
- Review procurements for registration in the New York City Financial Management System (FMS) by contract department and accounting department.
- Confirm funding source availability for procurements and change orders.
- Register City Capital funds and communicate with Project Management, Procurement and Budget departments to communicate requests submitted by NYC Comptrollers Offices.
- Review funding issues with CUCF Budget unit.
- Participate in the development process for Contract Review and Approvals with various agencies (i.e. NYC Comptroller, OSC, and CUNY/CUCF General Counsel).
- Review and prepare lapsing exercise by the NYC Comptroller.
NOTE: Until further notice, this is a hybrid position, eligible to work remotely and work on-site in the office. QUALIFICATIONS Minimum Bachelor's Degree and eight years' related experience required. Preferred The ideal candidate should demonstrate or possess: - Bachelor's degree in related field, business, finance, public administration.
- At least 8 years procurement experience in Higher education or comparable organization.
- Experience managing a diversity program either in a public or private setting.
- Detail oriented and accurate with strong quantitative, financial, and critical analysis skills plus evaluation and research skills.
- Excellent written, verbal and interpersonal communication skills, plus negotiation and presentation skills.
- Strong organizational skills with the ability to establish plans, manage a large workload, multiple assignments, conflicting priorities and meet deadlines in a time-sensitive office.
- Experience and knowledge of NYS and NYC procurement regulations and laws such as State Finance Law and the Procurement Policy Board (PPB) rules strongly preferred.
- Experience with New York City and/or New York State procurement processes, including knowledge and experience of FMS and/or the New York Statewide Financial System (SFS)PeopleSoft system.
- Experience with public/governmental design and construction processes.
CUNY TITLE OVERVIEW Directs a College's purchasing and contracting operations including staff supervision and legal compliance. - Oversees the procurement of all goods and services necessary for a College's operations within the parameters of CUNY and NYC procurement regulations.
- Represents the College on purchasing and contract matters, providing expertise and guidance during the bidding, selection, negotiation and contract processes.
- Manages and supervises the purchasing office staff to assure all activities related to goods and services are performed in accordance with the applicable guidelines and regulations.
- Manages the Board Resolution process for contracts and purchases in excess of mandated amounts.
- Liaisons with College, University and governmental representatives.
- Provides reports to the executive administration on department operations as required.
